Terms of Service

These Terms of Service ("Terms") govern your use of the Zap The Weight mobile application (the "App") and the website zaptheweight.com (the "Site"), together the "Service", operated by Zap The Weight ("we", "us"). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Not medical advice
The Service provides general wellness, nutrition, and activity guidance — including calorie, protein, and macro estimates, meal suggestions, meal-timing (time-restricted eating) tools, and step goals. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the judgment of a qualified health professional. Always consult your doctor before starting any weight-loss plan, fasting protocol, or exercise program — especially if you are pregnant or nursing, have a medical condition (including diabetes or other blood-sugar conditions, high blood pressure, kidney disease, or an eating disorder), or take medication. Stop and seek medical help if you feel unwell.
1a. Medicines, reminders and pill identification
These features carry more risk than the rest of the App, so they get their own terms.
- Identifying a pill is a lookup, not an identification. When you photograph a tablet, the App reads the markings on it and searches the FDA's published drug labelling for a product that carries those markings and looks the same. It is correct roughly three times in five, it declines to answer the rest of the time, and it can be wrong when it does answer. Never take a medicine, or give one to anybody else, on the strength of what the App says. A pharmacist will identify a pill for free, in person, and reliably.
- Leaflet text is the FDA's, reproduced as published. Where the App shows what a medicine is for, its side effects or its warnings, that text comes from the manufacturer's labelling as filed with the U.S. Food and Drug Administration. We do not write it, edit it or check it. It may be out of date, may describe a different manufacturer's version of the same medicine, and is not written about you. Labelling is United States labelling and may not apply elsewhere.
- Reminders are a convenience, not a guarantee. A reminder can fail to arrive for reasons outside our control — the phone is off, silent, out of battery, in Do Not Disturb, or the operating system has restricted the App in the background. Do not rely on the App as your only means of remembering to take a medicine, particularly one where a missed or doubled dose matters.
- Ranges are general, not personal. Where the App judges a reading against a range — including a range adjusted for a condition you told us about — that range comes from published general guidance such as ADA or AHA targets. Your clinician's target for you personally overrides it.
- Reports are a record of what you entered. An exported report is a presentation of your own self-recorded figures. It is not a clinical document, the measurements are not clinical readings, and no part of it has been reviewed by anyone.
2. Who may use the App
You must be at least 13 years old to use the Service. If you are under 18, you should use it with a parent's or guardian's involvement. The App's plans are designed for adults and teens 13+ as reflected in its setup questions.
3. Your responsibilities
- Provide reasonably accurate information during setup — the App's targets are only as good as what you tell it.
- Use game features ("Play") only where and when it is safe to look at your phone — for example while seated or on slow, focus-paced exercise equipment. Never while driving.
- Nutrition estimates (including AI photo estimates and barcode lookups) are approximations. Confirm anything that matters — especially if you manage a medical condition through diet.
- Keep your device secure. App data lives on your device (see our Privacy Policy), and you control backups.
4. Purchases and Premium
The App is free to download. Optional Premium features and consumable credits (for example photo-recognition and barcode-scan credits) may be offered for purchase through Google Play. All billing, cancellation, and refund handling for those purchases is done by Google Play under its terms. Prices and included features may change; changes will not reduce anything you have already purchased.
5. Intellectual property
The Service, including its logo, name, design, graphics, food database, and software, is owned by us or our licensors and is protected by copyright and trademark law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your Android device for personal, non-commercial purposes. You may not copy, modify, sell, reverse-engineer, or redistribute the Service except where the law allows it regardless of these Terms.
6. Third-party services
Some features rely on third-party services: AI photo recognition — of meals, and of medicines and their labels — is processed by Google's Gemini API; barcode nutrition lookups query the Open Food Facts database; medicine information comes from the U.S. Food and Drug Administration's openFDA service and the U.S. National Library of Medicine's RxNorm; and distribution and billing are handled by Google Play. Those services have their own terms and privacy practices, and we are not responsible for them.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates (calories, macros, steps, calories burned, or timelines) are exact.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health outcome, or lost profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us through the Service in the 12 months before the claim (or US $10 if you paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
You may stop using the Service at any time — uninstalling the App removes it and its on-device data. We may suspend or end the Service (or your access to it) if you break these Terms or if we discontinue the Service; where reasonable we will give notice.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above always shows the current version, and material changes will be highlighted in the App or on the Site. Continuing to use the Service after a change means you accept the updated Terms.
